Terms and Conditions

1. General Terms

1.1 Agreement: By booking videography services with MPS Videography , the client (“Client”) agrees to these Terms and Conditions. These terms govern all videography services provided by [Business Name] (“Company”).

1.2 Services Provided: The Company will provide the videography services as outlined in the selected package. Customization requests, add-ons, and additional services are subject to agreement and may incur additional charges.

2. Booking & Payment

2.1 Booking: To confirm a booking, a non-refundable deposit of 50% of the total service price is required upon booking confirmation. The remaining balance is due upon delivery of the final product.

2.2 Payment Methods: Payments may be made via bank transfer, credit card, or other agreed-upon payment methods. The Client will receive an invoice for both the deposit and final balance.

3. Cancellations & Rescheduling

3.1 Cancellation by Client: If the Client cancels the service more than 14 days before the scheduled date, the deposit is non-refundable. Cancellations made within 14 days of the event will incur a 50% cancellation fee of the total service price.

3.2 Cancellation by Company: In the rare event that the Company must cancel the service due to unforeseen circumstances (e.g., illness, equipment failure), the Client will be offered a full refund of the deposit or the opportunity to reschedule at a mutually agreed date.

3.3 Rescheduling: If the Client needs to reschedule, the deposit can be applied to a new date if the Company is available. Rescheduling within 14 days of the event may incur additional fees depending on the situation and availability.

4. Deliverables

4.1 Delivery of Final Product: The final video (or videos) will be delivered in the agreed-upon format(s) within 4-6 weeks after the event or shoot. Rush editing may be available for an additional fee.

4.2 Revisions:

  • Each package includes a specific number of revisions (e.g., 1 or 2 rounds). Any additional revisions beyond the included amount will incur a fee of $150 per hour of editing time.
  • Revisions must be requested in writing and are limited to changes in the content or structure of the video. Color grading, sound correction, or re-editing are subject to the availability of source material.

4.3 Raw Footage: Raw footage is not included unless specifically requested. Clients wishing to obtain raw footage will be charged an additional fee of $300.

4.4 Rights to Final Video: Upon full payment, the Client will receive rights to the final edited video for personal, non-commercial use. The Company retains the right to use the footage for promotional purposes, such as portfolio work, website, social media, and marketing materials, unless otherwise agreed in writing.

5. Travel & Additional Fees

5.1 Travel Fees: Travel is included within a 50-mile radius of [Location]. For events or shoots outside of this radius, the Client will be responsible for travel expenses, including transportation, accommodation (if necessary), and per diem expenses. Travel fees will be provided upon request and agreed upon before booking.

5.2 Additional Hours: If the Client requests additional coverage beyond the hours outlined in the selected package, the Client agrees to pay an additional fee of PKR 15K per hour.

6. Client Responsibilities

6.1 Access to Venue: The Client is responsible for providing the videographer(s) with access to the event venue, including any necessary permissions or permits. The Client should also ensure that the Company has access to key locations, lighting, and any other resources needed for the shoot.

6.2 Guest Cooperation: The Client agrees to inform guests and participants that video recording will occur during the event. The Company is not responsible for guests who object to being filmed.

6.3 Accuracy of Information: The Client is responsible for ensuring that all information provided to the Company, including event details, schedule, and contact information, is accurate and complete.

7. Equipment & Liability

7.1 Equipment Failure: While the Company makes every effort to ensure that all equipment is in good working order, in the rare event of equipment failure, the Company will do its best to repair or replace it. However, the Client understands that no guarantees can be made regarding the outcome or timing of video production.

7.2 Force Majeure: The Company shall not be liable for any failure or delay in performance due to circumstances beyond its control, including but not limited to weather, natural disasters, accidents, or other events beyond the Company’s reasonable control.

7.3 Damage to Property: The Client is responsible for any damage caused to the Company’s equipment due to negligence or misconduct at the event or shoot location. Any damages will be billed to the Client at the cost of repair or replacement.

8. Copyright & Usage

8.1 Copyright Ownership: The Company retains copyright over all raw footage, final videos, and any other creative work produced as part of the service. The Client receives a non-exclusive license to use the final edited videos for personal or business purposes, as outlined in the package.

8.2 Permission for Music & Licensing: The Company uses licensed music and third-party content for video production. Clients are prohibited from using final videos containing copyrighted music or content for commercial purposes unless they obtain their own licenses.

9. Indemnification

9.1 Indemnity: The Client agrees to indemnify and hold harmless the Company, its employees, contractors, and agents against any claims, damages, or losses arising from the use of the videos, including but not limited to issues related to copyright, unauthorized usage, or defamation.

10. Privacy & Confidentiality

10.1 Privacy: The Company respects the Client’s privacy and will not share any sensitive personal information without prior consent. Any media or footage captured during an event may be used for marketing and portfolio purposes unless the Client requests otherwise in writing.

11. Governing Law

11.1 Law: These Terms and Conditions shall be governed by the laws of the state/province in which the Company operates, and any disputes shall be resolved in the courts of that jurisdiction.

12. Modifications

12.1 Changes to Terms: The Company reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to the Client prior to the commencement of services.
